A Zoning Hearing Application, dated August 2, 2019 and filed on August 5, 2019 by Lobar Properties, LLC, relative to certain real property owned by Agricultural Commodities, Incorporated, described by the Applicant as Lot 1 of real property located at 1750 Granite Station Road, Gettysburg, Straban Township, Adams County, Pennsylvania (a portion of certain real property identified by Adams County Tax Parcel ID No. 38H11-0036F–000). The real property, which is the subject of the zoning hearing, is zoned and located within an Economic Development – Intense District (EC-2), as established by the Straban Township Zoning Ordinance. The subject real property is being proposed for future development, construction and use as a State Police Station. The Applicant is requesting the grant of a special exception pursuant to section 140-13.B.(1) and section 140-17.D. of the Zoning Ordinance for an outdoor trap, skeet, rifle, pistol or archery range (private or municipal). The Applicant is also seeking variance relief from section 140-13.D.(4) of the Zoning Ordinance relative to the requirement that no parking is permitted to be placed between the plane of any primary facade of a principal building and the road right-of-way on nonresidential lots located in the EC-2 Zoning District.

The Zoning Hearing Board of Straban Township will hold a public meeting to conduct two (2) zoning hearings on Thursday, August 29, 2019 commencing at 7:00 p.m. at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, to consider the following applications:
1. An Amended Zoning Hearing Application, dated July 24, 2019 and filed on July 29, 2019 by the Gettysburg Municipal Authority, relative to certain real property located at 155 Natural Springs Road, Gettysburg, Pennsylvania, in Straban Township and identified as Adams County Tax Parcel ID No. 38G13-0004A–000. The real property, which is the subject of the zoning hearing, is zoned and located within an Economic Development – Commercial District (EC-1) as established by the Straban Township Zoning Ordinance. The Applicant is requesting variance relief from Section 140-31.A.(2)(a) of the Zoning Ordinance which provides that in order for maximum height regulations not to apply to a public utility tower or structure, such structure must be set back from any property line a horizontal distance at least equal to its height. The Applicant is requesting the variance in connection with its proposed replacement of an existing water tank on the subject real property with a taller water tank of 115 feet in height which would be set back a horizontal distance of 54 feet from the nearest property line, as proposed.
2. A Zoning Hearing Application, dated July 31, 2019 and filed on that date by the Gettysburg Trading Post, relative to certain real property owned by George Chorba, Jr. and Christine Chorba, located at 2218-2222 York Road, Gettysburg, Pennsylvania, in Straban Township and identified as Adams County Tax Parcel ID No. 38H12-0023A–000. The real property, which is the subject of the zoning hearing, is zoned and located within an Economic Development – Commercial District (EC-1), as established by the Straban Township Zoning Ordinance. The Applicant is requesting the grant of a special exception pursuant to Section 140-6.D. of the Zoning Ordinance for a legal use not specifically allowed elsewhere in the Zoning Ordinance provided that such use meets the general requirements for a special exception and does not constitute a public or private nuisance. The Applicant requests special exception approval to operate an indoor firearms range accessory to its commercial firearms sales facility located at its business address of 2222 York Road, Gettysburg, Pennsylvania.

The Zoning Hearing Board of Straban Township will hold a public meeting to conduct a zoning hearing on Tuesday, July 16, 2019 commencing at 7:00 p.m. at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, to consider the following application:

An Application for Special Event Permit, dated and filed on June 25, 2019 by the Ancient Order of Hibernians, Adams County Division 1, relative to real property owned by the McSherrystown Lodge No. 720, Loyal Order of Moose, at the Gettysburg Moose Park, 100 Moose Road, Gettysburg, Pennsylvania, in Straban Township and identified as Adams County Tax Parcel ID No. 38H12-0007—000. The real property, which is the subject of the Application for Special Event Permit, is zoned and located within an Economic Development – Intense District (EC-2) as established by the Zoning Ordinance. The Applicant requests the issuance of a special event permit in order to hold a special event at the Gettysburg Moose Park pursuant to section 140-43 of the Zoning Ordinance which authorizes special event uses by special exception in every zoning district within Straban Township. The Applicant is also requesting variance relief from section 140-43.A.(2) of the Zoning Ordinance requiring an application for a special event permit to be submitted to the Township no later than 75 days prior to the beginning of the proposed special event, which is the 2019 Irish Festival to be held on July 20, 2019.

The Zoning Hearing Board of Straban Township will hold a public hearing to conduct two (2) zoning hearings on Tuesday, July 9, 2019, commencing at 7:00 p.m. at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, to consider the following applications:
1. A Zoning Hearing Application dated May 20, 2019 and filed on that date by Swift Run Foursquare Church and the International Church of the Foursquare Gospel, relative to adjoining real properties located at 225 New Chester Road, New Oxford, Pennsylvania, in Straban Township and identified as Adams County Tax Parcel ID No. 38I11-0065—000 and Adams County Tax Parcel ID No. 38I11-0064—000. The adjacent real properties, which are the subject of the Zoning Hearing Application, are both zoned and located within a Rural Residential District (R-R) as established pursuant to the Straban Township Zoning Ordinance. The Applicants are requesting the grant of a special exception pursuant to section 140-26.B. of the Zoning Ordinance for the extension of a nonconforming use onto an adjacent real property, also owned by the International Church of the Foursquare Gospel, for the purpose of expansion of the paved parking area serving the existing place of worship use being made at the real property at 225 New Chester Road. The Applicants are also requesting variance relief from section 140-26.B.(1) of the Zoning Ordinance which requires that such extensions shall be limited to the lot containing the use at the time the use became nonconforming.

2. An Application for Special Event Permit, dated May 1, 2019 and filed on May 31, 2019 by Gateway Gettysburg/Wyndham Gettysburg and the Gettysburg Wine & Music Festival, relative to real property owned by Gateway Gettysburg Land, LP and Gateway Gettysburg Hotel/Conference Center Partners, LP, which is located at 95 Presidential Circle, Gettysburg, Pennsylvania, in Straban Township and identified as Adams County Tax Parcel ID No. 38G12-0158—000 and Tax Parcel ID No. 38G12-0158A—000. The real properties, which are the subject of the Application for Special Event Permit, are zoned and located within an Economic Development – Commercial District (EC-1) as established by the Zoning Ordinance. The Applicants request the issuance of a special event permit in order to hold a special event at the Gateway Gettysburg Complex pursuant to section 140-43 of the Zoning Ordinance which authorizes special event uses by special exception in every zoning district within Straban Township. The special event being proposed by the Applicants is the 2019 Gettysburg Wine & Music Festival to be held on September 7th and September 8th, 2019.

The Zoning Hearing Board of Straban Township will hold a public hearing on Tuesday, April 16, 2019, at 7:00 p.m. in the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, to consider the following:
The Applicant is Gateway Gettysburg/Wyndham Gettysburg, 95 Presidential Circle, Gettysburg, PA.; Parcel ID: 38G12-0158—000 and 38G12-0158A–000.  The property is located in the Economic Development – Commercial District (EC-1) as established by the Straban Township Zoning Ordinance.
The Applicant requests the grant of special exceptions in order to hold five (5) special events on the subject property. Subsection 140-43.G. of the Zoning Ordinance authorizes special event uses by special exception in every zoning district within Straban Township.  The special events being proposed by the Applicant are identified as follows and would be held on the following dates:

The Applicant also requires variance relief from subsection 140-43.A.(2) of the Zoning Ordinance which requires that an application for a special event be submitted no later than 75 days prior to the beginning of a special event.  The Applicant filed its application with Straban Township 72 days prior to the beginning of the proposed special event to be held May 10–11, 2019.
The Applicant further requires variance relief from subsection 140-43.E.(9) of the Zoning Ordinance for the conduct of the proposed special event to be held July 15–21, 2019. Subsection 140-43.E.(9) of the Zoning Ordinance sets forth that no special event shall occur over a period of time of more than five days, whether consecutive or nonconsecutive.

The Straban Township Board of Supervisors will hold a public hearing on March 25, 2019 to accept verbal and written comment regarding the draft Central Adams Joint Comprehensive Plan. The public hearing will be held at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA 17325. The public hearing will commence at 6:00 p.m.

AN ORDINANCE OF STRABAN TOWNSHIP, PENNSYLVANIA, AMENDING CHAPTER 140, ZONING, TO PROVIDE FOR MEDICAL MARIJUANA DISPENSARIES AND GROWERS/PROCESORS CONSISTENT WITH THE PENNSYLVANIA MEDICAL MARIJUANA ACT; TO PROVIDE FOR THE COLOCATION OF WIRELESS FACILITIES; AMENDING LANGUAGE REGARDING HEARINGS BEFORE THE ZONING HEARING BOARD; AMENDING SIGN REGULATIONS FOR DRIVE-THROUGH MENU BOARDS; PROVIDING FOR FIREWORKS SALES FACILITIES; AMENDING THE FRONT SETBACK EXCEPTION; MODIFYING FRONT SETBACKS IN RESIDENTIAL RURAL DISTRICTS; AND AMENDING THE HEIGHT OF ACCESSORY STRUCTURES;

The purpose of the proposed ordinance is to amend certain sections of Chapter 140 of the Code of the Township of Straban by amending various zoning regulations as set forth below.

Section 1. Chapter 140, Article II, Section 140-5 is amended to add definitions for certain terms as a result of recent legislation from the General Assembly.
Section 2. Chapter 140, Article III, Section 140-13(B), Table 140-13-1, EC-2 Allowed Uses is amended to include medical marijuana dispensary/grower producer as a permitted use.
Section 3. Chapter 140, Article III, Section 140-12-1 is amended to add medical marijuana dispensary as a permitted use.
Section 4. Chapter 140, Article IV is amended to add a new Section 140-20(H) to include certain regulations for Medical Marijuana Facilities.
Section 5. Chapter 140, Article III, Tables 140-7-1 through 140-13-1, are amended to include “communications antennas mounted on an existing wireless support structure” as Transportation/Utility Uses.
Section 6. Chapter 140, Article IX, Section 140-61(B)(3) is amended to provide clarification to the time requirement for the first hearing before the Zoning Hearing Board.
Section 7. Chapter 140, Article VIII, Section 140-54(G)(3) is amended to read “Reserved.”
Section 8. Chapter 140, Table 140-55 is deleted.
Section 9. Chapter 140, Article III, Tables 140-12-1 and 140-13-1 are amended to include Consumer Fireworks Sales Facility as a permitted use.

AN ORDINANCE OF STRABAN TOWNSHIP, PENNSYLVANIA AMENDING CHAPTER 117, SUBDIVISION OF LAND, TO PROVIDE FOR ELIMINATION OF LANGUAGE REFERENCING THE THREE YEAR PERIOD FOR A REFUND OF UNUSED FUNDS PROVIDED IN SECTION 503 OF THE PENNSYLVANIA MUNICIPAL PLANNING CODE AND PROVIDING CLARIFICATION THAT ALL SIDEWALKS WITHIN THE TOWNSHIP SHALL BE FIVE FEET IN WIDTH.

The purpose of the proposed ordinance is to amend certain sections of Chapter 117 of the Code of the Township of Straban in conformity with provisions of the Pennsylvania Municipalities Planning Code (“MPC”), and to clarify Township sidewalk width requirements.

Section 1. Chapter 117, Section 117-50(F) is amended to conform to the language of Section 503(11)(vii) of the MPC.
Section 2. Chapter 117, Section 117-41(D) is amended to clarify that all sidewalks within the right of way of the street shall be at least five feet wide.
Section 3. Appendix 2, Curb and Sidewalk specifications, are amended to reflect the revised sidewalk width requirement.
