PUBLIC HEARING – October 7, 2019

Notice is hereby given that the Straban Township Board of Supervisors will hold a public hearing on Monday, October 7, 2019 at 6:30 p.m. at the Municipal Building, 1745 Granite Station Road, Gettysburg. The Board intends to adopt the Ordinance following the hearing at 7:00 p.m.
AN ORDINANCE OF STRABAN TOWNSHIP, ADAMS COUNTY, PENNSYLVANIA, AMENDING THE CODE OF THE TOWNSHIP OF STRABAN, BY ADDING TO CHAPTER 112, ENTITLED “STREETS AND SIDEWALKS”, AN ARTICLE II, ENTITLED “STREET OPENINGS AND EXCAVATIONS”, REGULATING OPENINGS AND EXCAVATIONS IN OR UNDER THE STREETS, HIGHWAYS, AND RIGHTS-OF-WAY OF THE TOWNSHIP OF STRABAN.
The purpose of the proposed ordinance is to supplement Chapter 112 of the Code of the Township of Straban by adding an Article II, entitled “Street Openings and Excavations”, which promulgates regulations governing entities who desire to create openings or excavations within the public rights-of-way, in order to ensure that the health, safety, and public welfare of the Township’s residents is maintained.
Section 1. Definitions. Section 1 provides definitions for “engineer”, “excavation”, “newly paved street”, “permittee”, “person”, and “street”.
Section 2. Permit Required. Section 2 makes it unlawful for any person to make an opening or excavation in any right-of-way of the Township without a permit. The Zoning Officer is tasked with the administration of reviewing and issuing permits.
Section 3. Application for Permit. Section 3 contains information requiring the required application process for a permit.
Section 4. Permit Fee. Section 4 provides that a permit fee shall be charged by the Township. The fee will be set forth in the Township Fee Schedule. Additional fees, including diminution fees for newly paved streets, are set forth. No permit shall be issued until all relevant fees have been paid.
Section 5. Financial Security and Insurance Required. Section 5 provides that prior to the issuance of a permit, the Permittee shall deposit financial security with the Township in an amount approved by the Township, and shall provide documentation of comprehensive general liability insurance. Section 5 contains more specific details on the financial security and insurance requirements.
Section 6. Excessive Excavating and Permittee Responsibilities. Section 6 provides specific overlay requirements where a Permittee performs excessive excavation, as defined therein.
Section 7. Protective Measures. Section 7 contains specific requirements that a Permittee engaged in a street opening or excavation must undertake for the benefit of public safety. Section 7 authorizes the Township to undertake the protective measures if the Permittee fails to do so, and invoice the entity for the Township’s costs in undertaking the protective measures.
Section 8. Rectification of Improper or Incomplete Work. Section 8 provides for procedures in the event that the street opening/excavation is not properly completed to the satisfaction of the Township engineer. Section 8 authorizes the Township to take the necessary measures to rectify the entity’s failure to do so, and to assess the costs thereof to the Permittee.
