Zoning Hearing – September 30, 2015

The Straban Township, Adams County, PA, Zoning Hearing Board will hold a public hearing on September 30, 2015, at 7:00 p.m. in the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, to consider the following:

Kirby Land Holdings, LLC: Zoning application regarding property located at the Adams Commerce Center, Lot 23 along U.S. Route 30 in Straban Township. The property is located in the EC-1 zoning district established by the Straban Township zoning ordinance. The property is designated as tax parcel no. 38-G-12-0169 and is owned by Kirby Land Holdings, LLC.

The applicant requests the following relief in its application:

1. An appeal from a notice of zoning ordinance violation issued to Applicant by the Straban Township zoning officer on August 3, 2015. The alleged violations include: (a) development of land by constructing a gravel parking lot on the aforesaid lot 23 without obtaining a land use permit; (b) construction of the aforesaid gravel parking lot which encompasses approximately 108 feet by 130 feet without a storm water management plan; and (c) reversal of a requirement that the fill and gravel used in construction of the lot be removed.
2. Request for the following variances: (a) postponement of Route 30 streetscape requirements set forth in section 140–12 (H) (1)–(8) for a period of 12 months until the issue of permanent use of said lot 23 is resolved; and (b) postponement of lot setback requirements set forth in section 140–12 (D) (1) for a period of 12 months until the issue of a permanent use of the lot is resolved.
3. Application for a special exception to permit use of the gravel lot area to be used for temporary inventory display for new cars and trucks for a period of 12 months until the permanent use is resolved.
