Zoning Hearing Board – May 28, 2024

The Zoning Hearing Board of Straban Township will hold a public meeting on Tuesday, May 28, 2024, commencing at 6:00 p.m., at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, for the purpose of conducting a zoning hearing to consider the following application:
A Zoning Hearing Application, dated March 29, 2024 and filed on April 1, 2024 by TKC CCXXX LLC. (the “Applicant”) relative to the Gettysburg Shopping Center real property located at 1530 York Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G12-0049—000. The subject real property is zoned and located within the Economic Development – Commercial District (EC-1), as established by the Straban Township Zoning Ordinance and as depicted on the Zoning Map of Straban Township. The Applicant is requesting the grant of a variance from the requirements of Section 140-12.E. of the Zoning Ordinance, which provides that no parking is permitted to be placed within the front yard parking setback area and which further requires that on parcels with multiple principal buildings, the principal building closest to each road right-of-way shall be used to determine the front yard parking setback area. In connection with the location, construction and use of a proposed 11,142 square foot multi-tenant retail store on Lot 2 of the Shopping Center property, the Applicant is requesting to locate the required front yard parking area on Lot 2 behind the extended principal building setback line as located on the adjacent and previously developed Lot 3. The Applicant asserts that the front yard parking setback along the Route 30 right-of-way for the Shopping Center property should be determined by the location of the principal building front yard parking setback line on adjacent Lot 3, which lot is served by the same access roads and common utilities as the Shopping Center.
