A Zoning Hearing Application, dated March 29, 2024 and filed on April 1, 2024 by TKC CCXXX LLC. (the “Applicant”) relative to the Gettysburg Shopping Center real property located at 1530 York Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G12-0049—000. The subject real property is zoned and located within the Economic Development – Commercial District (EC-1), as established by the Straban Township Zoning Ordinance and as depicted on the Zoning Map of Straban Township. The Applicant is requesting the grant of a variance from the requirements of Section 140-12.E. of the Zoning Ordinance, which provides that no parking is permitted to be placed within the front yard parking setback area and which further requires that on parcels with multiple principal buildings, the principal building closest to each road right-of-way shall be used to determine the front yard parking setback area. In connection with the location, construction and use of a proposed 11,142 square foot multi-tenant retail store on Lot 2 of the Shopping Center property, the Applicant is requesting to locate the required front yard parking area on Lot 2 behind the extended principal building setback line as located on the adjacent and previously developed Lot 3. The Applicant asserts that the front yard parking setback along the Route 30 right-of-way for the Shopping Center property should be determined by the location of the principal building front yard parking setback line on adjacent Lot 3, which lot is served by the same access roads and common utilities as the Shopping Center.

The Zoning Hearing Board of Straban Township will hold a public meeting on Thursday, April 18, 2024, commencing at 6:00 p.m., at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, for the purpose of conducting a zoning hearing to consider the following application:

A Zoning Hearing Application, dated March 6, 2024 and filed on that same date by Brigida, LLC. (the “Applicant”) relative to certain real property owned by Getty Auto Sale & Service LLC, and located at 50 Sandoe Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G10-0007B–000. The real property, which is the subject of the zoning hearing, is zoned and located within a Mixed Use – Village District (MU-1), as established by the Straban Township Zoning Ordinance, as amended (the “Zoning Ordinance”), and as depicted on the Zoning Map of Straban Township. The Applicant is requesting the grant of a use variance from Section 140-10.B., Table 140-10-1, MU-1 Allowed Uses, of the Zoning Ordinance in order to authorize a contractor headquarters use on the real property.

Zoning Hearing Board – February 27, 2024

The Zoning Hearing Board of Straban Township will hold a public meeting on Tuesday, February 27, 2024, commencing at 7:00 p.m., at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, for the purpose of conducting a zoning hearing to consider the following application:

A Zoning Hearing Application, dated December 13, 2023 and filed on December 15, 2023 by Straban 30 Developers LLC (the “Applicant”) relative to certain real property owned by Gateway Gettysburg Land, LP, and located within the Gateway Gettysburg development and complex in Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G12-0158—000. The real property, which is the subject of the zoning hearing, is zoned and designated within the Economic Development – Commercial District (EC-1), as well as the Convention and Visitors Center Development Overlay (CVC) District and the Distribution, Terminal, and Fulfillment Overlay (DTF) District, each of the aforesaid Districts as established by the Straban Township Zoning Ordinance, as amended (the “Zoning Ordinance”). The Applicant is requesting variance relief from the following provisions of the Zoning Ordinance in connection with the development of a proposed Wawa convenience store with a fueling station and a Popeyes Louisiana Kitchen quick-service restaurant on the real property: 1. Section 140-12.D, Table 140-12-2 – to authorize Wawa’s fuel canopy to encroach a maximum of 16.5 feet into the required 60-foot front yard setback along York Road (US 30); 2. Section 140-19.N.(3)(a) and Section 140-12.D, Table 140-12-2 – to authorize Wawa’s fuel dispensers to encroach a maximum of 6.1 feet into the required 60-foot front yard setback and 26.1 feet into the required 80-foot front yard setback along York Road (US 30); 3. Section 140-19.N.(2) – to authorize 9 off-street parking spaces between the Wawa building and its fuel canopy; 4. Section 140-52.A.(1) – to eliminate the requirement for an off-street loading area accessory to the Popeyes restaurant unit; 5. Section 140-19.B.(3) – to eliminate the requirement for separation between Popeyes restaurant drive-through lane and its parking aisles and accessways; 6. Section 140-12.H.(6) – to authorize three (3) wall-mounted signs on the Wawa fuel canopy where up to two (2) wall-mounted signs are permitted; 7. Section 140-54.E.(7) – to authorize the primary façade of the Wawa fuel canopy to maintain less than 50% of the total sign area of the canopy’s wall-mounted signs; and 8. Section 140-12.H.(6) – to authorize three (3) wall-mounted signs on the Popeyes restaurant building where up to two (2) wall-mounted signs are permitted.

A Zoning Hearing Application, dated November 27, 2023 and filed on December 4, 2023 by Helicopter Applicators, Inc. (the “Applicant”) relative to certain real property located at 1670 York Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G12-0048—000. The real property, which is the subject of the zoning hearing, is zoned and located within the Economic Development – Commercial District (EC-1), as established by the Straban Township Zoning Ordinance. The Applicant proposes to construct an accessory storage building that is 11,200 square feet in area, and requests the grant of a variance to Zoning Ordinance Section 140-12.H. requesting relief from the required installation, at the time of development and construction of the accessory building and any related improvements, of U.S. Route streetscape enhancements to include street lighting, building highlighting, street trees, sidewalks, building landscaping, business signage, and trash storage.

A Zoning Hearing Application, dated and filed on October 4, 2023 by Agricultural Commodities, Inc., relative to certain real property located at 1609 Granite Station Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38H11-0044—000. The real property, which is the subject of the zoning hearing, is zoned and located within the Economic Development Intense District (EC-2), as established and designated pursuant to section 140-6.A. of the Straban Township Zoning Ordinance. The Applicant is proposing the location, construction and use of an auxiliary parking area on the subject real property to provide safe and convenient employee parking for the Applicant’s office building and facilities associated with its agribusiness use of certain adjacent real property located at 1585 Granite Station Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No. 38H11-0045—000. The Applicant is requesting the grant of a dimensional variance from the minimum front setback requirement of 150 feet to enable the location, construction and use of the proposed employee parking area a minimum distance of 143 feet from the street line of Granite Station Road (T-486).

A Zoning Hearing Application, dated June 13, 2023 and filed on June 14, 2023 by Helicopter Applicators, Inc. (the “Applicant”) relative to certain real property located at 1670 York Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G12-0048–000. The real property, which is the subject of the zoning hearing, is zoned and located within the Economic Development (EC-1), as established by the Straban Township Zoning Ordinance. The Applicant has filed a request for a dimensional variance to allow the construction of an accessory building, exceeding 1,000 square feet in size, without the submission and filing of any land development plans and related reports for consideration and approval of the Board of Township Supervisors pursuant to the provisions of the Straban Township Subdivision and Land Development Ordinance. The Zoning Hearing Board of Straban Township will hold a public meeting on Tuesday, January 24, 2023, commencing at 7:00 p.m., at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, for the purposes of conducting the annual organization meeting of the Zoning Hearing Board to elect its officers and then to conduct two zoning hearings to consider the following applications:
A Zoning Hearing Application, dated November 15, 2022 and filed on November 17, 2022 by Randal H. and Karen R. Heflin (the “Applicants”) relative to certain real property located at 298 Thomas Drive, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38104-0085–000. The real property, which is the subject of the zoning hearing, is zoned and located within a Residential High Density District (R-2), as established by the Straban Township Zoning Ordinance. The Applicants have filed a request for a dimensional variance from the 35 foot minimum front yard setback in order to build an addition on the front of their house. The Applicants are requesting the grant of a variance from the lot standards regulating yards and setbacks contained in section 140-30 of the Zoning Ordinance and/or a variance from the dimensional requirements set forth in section 140-9 of the Zoning Ordinance, in order to exceed the permitted 35 foot setback from a local road, as provided in Table 140-9-2 titled “R-2 Area, Coverage and Dimensional Requirements” of the Ordinance.
A Zoning Hearing Application, dated December 6, 2022 and filed on December 7, 2022 by Rockstar Real Estate, LLC (the “Applicant”) relative to certain real property located at 3025 Old Harrisburg Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38G09-0058–000. The real property, which is the subject of the zoning hearing, is zoned and located within a Mixed Use Neighborhood District (MU-2), as established by the Straban Township Zoning Ordinance. The Applicant has filed a request for a use variance to retrofit and renovate an existing building with an area of approximately 6,000 square feet, as a storage, distribution and retail center for use by APR Supply Co. (the proposed “Use”). The Applicant is requesting the grant of a variance from section 140-11.B of the Zoning Ordinance.

The Zoning Hearing Board of Straban Township will hold a public meeting to conduct a zoning hearing on Tuesday, May 24, 2022, commencing at 7:00 p.m., at the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA, to consider the following:

A Zoning Hearing Application dated March 3, 2022 and filed on April 5, 2022 by Anne J. Knox and Erian Investment Co., Inc., relative to certain real properties located on the east side of Old Harrisburg Road (SR 3001), south of the Twin Oaks residential community, extending eastward to Hunterstown Road (SR 3003), Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID Nos: 38F12-0160—000 and 38G12-0110—000. The real properties, which are the subjects of the zoning hearing, are zoned and located within a Residential Low Density (R-1) District pursuant to the Straban Township Zoning Ordinance.

The Applicant is requesting the grant of a special exception for a cluster residential design use of the real properties pursuant to section 140-8.B(1) of the Zoning Ordinance. The Applicant is also seeking variance relief requesting a reduction from the perimeter buffer minimum width requirement of 100 feet for a cluster residential design use as set forth in subsection 140-15.B.(8)(a)[1] of the Zoning Ordinance.

A Zoning Hearing Application dated February 8, 2022 and filed on February 9, 2022 by York Water Company relative to certain real property located at 1640 Hunterstown Road, Gettysburg, Straban Township, Adams County, Pennsylvania, and further identified as Adams County Tax Parcel ID No: 38H11-0001D–000. The real property, which is the subject of the zoning hearing, is zoned and located within the Mixed Use – Neighborhood District (MU-2), pursuant to the Straban Township Zoning Ordinance.

The Applicant has filed an appeal from the decision of the Zoning Officer that the painting of letters spelling the name of the related development on a water tank constitutes an unpermitted wall sign. In the alternative, the Applicant is requesting the grant of a dimensional variance, pursuant to section 140-61 of the Zoning Ordinance, in order to exceed the permitted sign area, set forth in section 140-54 of that ordinance.
